Throughout these Terms, “Psyki”, “we”, “us” and “our” refer to Psyki. “Participant”, “you” and “your” refer to the individual booking, applying for or participating in a Psyki service.

By submitting a reservation, completing our screening process, making a payment, accepting an offer or participating in a Psyki programme, you agree to these Terms.

1. Applicability

1.1 These Terms apply to every offer, reservation, booking and agreement between Psyki and a Participant relating to a Psyki service or programme.

1.2 The description of the particular service, programme, retreat or session shown on our website, booking page, confirmation or other written communication forms part of the agreement.

1.3 If specific conditions are stated in an offer or booking confirmation, those specific conditions apply in addition to these Terms.

1.4 Where there is a conflict between these Terms and specific written conditions agreed with the Participant, the specifically agreed conditions take precedence.

1.5 Before an agreement is concluded electronically, the Participant will be given a reasonable opportunity to review these Terms and to save or reproduce them electronically.

2. Nature of Psyki Services

2.1 Psyki provides non-medical, non-therapeutic psychedelic retreat and experiential services in the Netherlands.

2.2 A Psyki psychedelic retreat or psilocybin-containing truffle experience is not medical treatment, psychiatric treatment, psychotherapy or regular mental healthcare (GGZ).

2.3 Psyki’s services are not intended to diagnose, treat, cure or prevent any medical or psychiatric condition.

2.4 Participation is not a substitute for treatment or care from a doctor, psychiatrist, psychologist, psychotherapist or other appropriately qualified healthcare professional.

2.5 The fact that a Psyki facilitator may hold qualifications in psychology, counselling, psychotherapy, medicine or another healthcare-related profession does not mean that they are acting in that regulated professional capacity when facilitating a Psyki retreat unless this has been expressly agreed under a separate professional treatment agreement.

2.6 Psyki does not guarantee that participation will improve a Participant’s psychological, emotional, physical, relational or general wellbeing.

3. Age Requirement

3.1 Participation in Psyki psychedelic programmes involving psilocybin-containing truffles is limited to persons aged 20 years or older.

3.2 Psyki may request proof of identity and age before confirming or allowing participation.

3.3 Meeting the minimum age requirement does not automatically mean that a Participant is suitable or eligible to participate.

4. Reservation and Screening

4.1 A Participant wishing to reserve a Psyki programme pays a €100 reservation fee, unless otherwise specified.

4.2 Payment of the reservation fee does not constitute final acceptance into the programme and does not guarantee participation.

4.3 Participation remains subject to Psyki’s screening and acceptance process.

4.4 The Participant must provide all information reasonably requested by Psyki for the purpose of assessing eligibility and suitability.

4.5 This may include information concerning physical health, mental health, medication, substance use, relevant medical or psychiatric history, family history and other circumstances relevant to participation.

4.6 The Participant warrants that the information supplied is complete and accurate to the best of their knowledge.

4.7 The Participant must inform Psyki of any relevant change occurring between completion of screening and participation in the programme, including changes to health, medication, pregnancy status or psychological wellbeing.

4.8 Psyki may request additional information or clarification before deciding whether to accept a Participant.

5. Acceptance or Declining a Reservation

5.1 Following screening, Psyki may:

a. accept the Participant;
b. request further information before making a decision; or
c. decline the Participant.

5.2 If Psyki declines a Participant during the initial screening process, the €100 reservation fee will be refunded.

5.3 If the Participant is accepted, the €100 reservation fee will be credited toward the total price of the programme.

5.4 Acceptance following screening does not remove Psyki’s right subsequently to determine that participation is unsafe or unsuitable.

5.5 Psyki may refuse, postpone, interrupt or terminate a Participant’s participation if, in Psyki’s reasonable judgment, circumstances affecting the Participant’s physical or psychological state make participation inappropriate or unsafe.

5.6 This right applies before and during the programme, including on the day on which psilocybin-containing truffles would otherwise be provided.

6. Formation of the Agreement

6.1 A reservation submitted through the Psyki website is an application to participate and not an unconditional acceptance by Psyki.

6.2 The agreement for participation is concluded when:

a. Psyki has completed any required screening;
b. Psyki has accepted the Participant; and
c. Psyki has communicated that acceptance to the Participant electronically or in writing.

6.3 Psyki may decline an application where there are reasonable grounds relating to safety, suitability, availability, legal or regulatory requirements, payment, incorrect information or other circumstances relevant to responsible provision of the service.

6.4 Psyki is not bound by obvious typographical, pricing or administrative errors contained in an offer or on the website.

7. Services

7.1 The exact content of a Psyki service will be described in the relevant programme description, offer or booking confirmation.

7.2 Depending upon the programme, services may include:

  • screening and suitability assessment;
  • preparation;
  • psychedelic facilitation;
  • a supervised experience involving fresh psilocybin-containing truffles;
  • integration;
  • food, refreshments and snacks;
  • psychologically informed support;
  • programme materials; and
  • other services expressly specified in the booking.

7.3 Accommodation is not included unless Psyki expressly states otherwise in writing.

7.4 Participants are responsible for arranging their own accommodation where needed.

7.5 Psyki will exercise reasonable care in providing the agreed services.

8. Prices and VAT

8.1 All consumer prices displayed by Psyki are inclusive of VAT, unless clearly indicated otherwise.

8.2 The total price and what is included will be communicated before the Participant becomes liable to pay the balance.

8.3 Once a programme has been confirmed, Psyki will not increase the price except where this is required by changes in taxation, VAT, law or other statutory requirements.

9. Payment

9.1 The €100 reservation fee is payable when a reservation is submitted.

9.2 If the Participant is accepted, the reservation fee forms part of the total programme price and will be deducted from the remaining amount payable.

9.3 Psyki will inform the Participant of the remaining balance and applicable payment deadline following acceptance.

9.4 Full payment must be received by the deadline stated in the booking confirmation.

9.5 Psyki may refuse participation where payment has not been made when due.

9.6 Failure to attend because payment requirements have not been met does not automatically entitle the Participant to a refund.

10. Cancellation by the Participant

10.1 A Participant may cancel their booking by notifying Psyki in writing at hello@psyki.co.

10.2 Unless otherwise stated in the particular offer, the following cancellation conditions apply after acceptance:

More than 2 months before the first scheduled Psyki service:
No programme fee is due.

Between 1 and 2 months before the first scheduled Psyki service:
50% of the total programme fee is due.

2 weeks or less before the first scheduled Psyki service:
100% of the total programme fee is due.

10.3 Where a Participant has already paid more than the amount due under clause 10.2, Psyki will refund the balance.

10.4 Where a Participant has paid less than the amount due, the outstanding amount remains payable.

10.5 Failure to attend, arriving in a condition that prevents safe participation, voluntarily leaving the programme after it has begun, or being removed for serious breach of these Terms may be treated as a late cancellation.

11. Rescheduling

11.1 Requests to reschedule must be submitted to Psyki as soon as reasonably possible.

11.2 Rescheduling is subject to availability and Psyki is not obliged to offer an alternative date.

11.3 Psyki may charge reasonable costs associated with a Participant-requested rescheduling where costs have already been incurred.

11.4 Psyki may waive or reduce cancellation or rescheduling charges at its discretion where circumstances justify doing so.

12. Statutory Withdrawal Rights

12.1 Where Dutch or European consumer law gives a Participant a statutory right of withdrawal, Psyki will respect that right.

12.2 Certain services associated with a particular date or period may be excluded from the statutory withdrawal right where the applicable law provides such an exception.

12.3 Nothing in these Terms is intended to exclude a mandatory consumer right which cannot legally be excluded.

13. Cancellation or Changes by Psyki

13.1 Psyki may cancel, postpone, relocate or make reasonable changes to a programme where necessary because of circumstances outside its reasonable control or where responsible delivery of the programme is no longer possible.

13.2 This may include:

  • illness or unavailability of essential personnel;
  • unsafe conditions;
  • venue problems;
  • insufficient availability;
  • governmental or regulatory measures;
  • changes affecting the lawful supply or use of psilocybin-containing truffles;
  • force majeure; or
  • circumstances materially affecting Participant safety.

13.3 Psyki may terminate an agreement where legal or regulatory developments make continued provision impossible, unlawful or unreasonably risky.

13.4 If Psyki cancels a programme and no suitable replacement is agreed, amounts paid for services that will not be provided will be refunded.

14. Participant Responsibilities

14.1 Participants must follow all reasonable instructions provided by Psyki and its facilitators.

14.2 Participants must not behave in a way which may negatively affect or endanger:

  • their own physical or psychological wellbeing;
  • another Participant;
  • Psyki staff or facilitators;
  • the venue;
  • property; or
  • the safe running of the programme.

14.3 Participants must attend free from alcohol, recreational drugs or other substances not agreed with Psyki.

14.4 Participants must not conceal information that may reasonably be relevant to safe participation.

14.5 Psyki may remove a Participant from a programme where the Participant seriously or repeatedly fails to follow safety instructions or otherwise creates an unacceptable risk.

15. Psilocybin-Containing Truffles

15.1 Psyki programmes may include the voluntary consumption of fresh psilocybin-containing truffles.

15.2 Psilocybin is the psychoactive substance responsible for the psychedelic effects of these truffles.

15.3 Truffles are a natural product. The precise concentration of active substances and an individual’s response cannot be guaranteed.

15.4 Psyki does not guarantee the nature, intensity or outcome of a psychedelic experience.

15.5 A Participant may experience an experience different from what they expected or hoped for.

15.6 Statements by Psyki or its facilitators concerning possible subjective effects, insights or outcomes are not guarantees.

16. Voluntary Participation

16.1 Participation is entirely voluntary.

16.2 The Participant remains free to ask questions before deciding whether to participate.

16.3 No Participant is required to consume psilocybin-containing truffles simply because they have booked or attended a programme.

16.4 The Participant acknowledges that the decision to participate is their own informed decision.

17. Suitability and Contraindications

17.1 Psyki’s screening process is intended to identify circumstances which may make participation inappropriate or require further consideration.

17.2 Psyki may decline or postpone participation where information supplied during screening indicates a relevant physical, psychological or psychiatric risk.

17.3 Factors considered may include, among others:

  • a personal or close family history of psychosis, schizophrenia or bipolar disorder;
  • significant psychiatric symptoms;
  • relevant substance dependence or misuse;
  • uncontrolled high blood pressure;
  • epilepsy or seizure disorders;
  • significant heart conditions;
  • uncontrolled diabetes;
  • pregnancy or breastfeeding;
  • relevant medication use;
  • acute psychological instability; or
  • other physical or psychological circumstances that Psyki considers incompatible with responsible participation.

17.4 This list is not exhaustive.

17.5 A Participant should not stop, reduce or alter prescription medication in order to qualify for a Psyki programme unless this has been discussed with the professional who prescribed or manages that medication.

18. Medication

18.1 Certain medications and substances can alter or interact with the effects of psilocybin-containing truffles.

18.2 Participants must accurately disclose relevant prescribed medication, non-prescription medication, supplements and other substances as requested during screening.

18.3 Psyki may request that a Participant consult their prescribing clinician or another suitable healthcare professional before participation.

18.4 Psyki does not instruct Participants to discontinue prescribed medication unless such advice is being provided within an appropriately authorised medical relationship.

19. Possible Effects and Risks

19.1 Psychedelic experiences may be pleasant, neutral, difficult, distressing, confronting or unpredictable.

19.2 Possible effects include, among others:

  • alteration of vision, hearing, smell, touch or taste;
  • changes in thoughts, perception and attention;
  • strong or rapidly changing emotions;
  • anxiety, fear or distress;
  • decreased sense of cognitive control;
  • nausea or vomiting;
  • disturbed balance or coordination;
  • drowsiness or confusion;
  • feelings of dissociation or disconnection;
  • altered sense of self, time or reality; and
  • other temporary psychological or physical effects.

19.3 Rare or persistent adverse effects may occur, including persistent or recurrent perceptual disturbances such as Hallucinogen Persisting Perception Disorder (HPPD).

19.4 By participating, the Participant acknowledges that psychedelic experiences inherently involve uncertainty and cannot be made entirely risk-free.

20. During the Psychedelic Experience

20.1 Participants must remain at the designated location until a Psyki facilitator determines that it is appropriate for them to leave.

20.2 Participants must follow reasonable safety instructions given by facilitators throughout the experience.

20.3 Psyki facilitators will remain available during the supervised psychedelic portion of the programme in accordance with the programme structure.

20.4 Psyki may take reasonable steps necessary to protect the Participant or others where an immediate safety concern arises.

21. Departure, Transport and Driving

21.1 Psyki programmes do not include overnight accommodation unless expressly stated otherwise.

21.2 After the session, the Participant will return to their own accommodation once Psyki considers them sufficiently recovered to leave.

21.3 Participants may not drive, operate dangerous machinery or engage in other activities requiring full unimpaired judgment for 24 hours following the end of the psychedelic session.

21.4 Participants must make appropriate arrangements to return safely to their accommodation, such as collection by another person or travel by taxi or another suitable form of transport.

21.5 Psyki may refuse to release a Participant into an obviously unsafe transport arrangement.

22. Important Decisions Following the Experience

22.1 Psychedelic experiences may temporarily affect a Participant’s perspective, emotional state or interpretation of significant life circumstances.

22.2 Participants are encouraged not to make major irreversible personal, professional, financial or relationship decisions immediately following a psychedelic experience.

23. No Guaranteed Outcome

23.1 Psyki does not promise or guarantee:

  • healing;
  • recovery;
  • symptom reduction;
  • personal transformation;
  • spiritual experience;
  • relationship improvement;
  • psychological insight; or
  • any particular subjective experience.

23.2 Testimonials, research, educational materials or descriptions of other Participants’ experiences do not constitute promises regarding an individual Participant’s outcome.

23.3 A Participant may experience no perceived benefit.

24. Assumption of Risk

24.1 The Participant acknowledges that participation in a psychedelic programme and the consumption of psilocybin-containing truffles involve risks.

24.2 The Participant voluntarily accepts the ordinary and inherent risks associated with the experience after having had the opportunity to obtain information and ask questions.

24.3 This clause does not exclude any liability that cannot lawfully be excluded under Dutch law.

25. Liability

25.1 Psyki will exercise reasonable care when providing its services.

25.2 To the extent permitted by law, Psyki is not liable for damage resulting from:

  • inaccurate, incomplete or withheld information supplied by the Participant;
  • failure to follow reasonable instructions;
  • conduct contrary to these Terms;
  • risks inherently associated with psychedelic participation which could not reasonably have been prevented through the exercise of due care; or
  • actions taken by the Participant after leaving Psyki’s supervision.

25.3 To the extent permitted by law, Psyki shall not be liable for indirect, special, punitive or consequential loss.

25.4 Nothing in these Terms excludes or restricts liability where such exclusion or restriction is prohibited by mandatory Dutch law.

26. Confidentiality Between Participants

26.1 Participants must respect the privacy and confidentiality of other Participants.

26.2 Personal information, stories, experiences, health information or other private information learned about another Participant during a programme may not be disclosed outside the programme without that person’s consent.

26.3 This confidentiality obligation continues after the programme has ended.

27. Privacy and Health Information

27.1 Psyki may process personal data reasonably necessary to:

  • manage reservations and payments;
  • communicate with Participants;
  • conduct screening;
  • assess eligibility;
  • plan and safely deliver services;
  • comply with legal obligations; and
  • handle complaints or incidents.

27.2 Screening may involve health-related personal information.

27.3 Personal information will be handled in accordance with Psyki’s Privacy Policy and applicable data-protection law.

27.4 Participants must provide accurate information and inform Psyki of material relevant changes before participation.

28. Intellectual Property

28.1 All programme materials, written content, exercises, recordings, designs, documents, educational materials and other intellectual property made available by Psyki remain owned by Psyki or the relevant rights holder.

28.2 Participants receive a personal, non-exclusive, non-transferable right to use such materials for their own participation and personal use.

28.3 Materials may not be copied, commercially exploited, sold, distributed, published or reproduced without Psyki’s prior written permission, except where permitted by law.

29. Complaints

29.1 Compliments, feedback and complaints may be sent to:

hello@psyki.co

29.2 A complaint concerning the performance of the agreement should be submitted promptly and should describe the issue clearly and completely.

29.3 Psyki aims to provide a substantive response within 30 days of receipt.

29.4 If more time is reasonably required, Psyki will acknowledge the complaint within 14 days and indicate when a fuller response can be expected.

29.5 The Participant should give Psyki a reasonable opportunity to resolve the complaint through consultation before commencing formal proceedings.

30. Severability

30.1 If any provision of these Terms is found to be invalid, unenforceable or partially invalid, the remaining provisions remain in effect.

30.2 Where reasonably possible, the invalid provision will be interpreted or replaced in a manner that most closely reflects its intended purpose while complying with applicable law.

31. Changes to These Terms

31.1 Psyki may amend these Terms from time to time.

31.2 The Terms applicable to a confirmed booking are normally those accepted by the Participant when the agreement was concluded, except where a change is required by law or expressly agreed with the Participant.

31.3 Material changes affecting an existing booking will be communicated where appropriate.

32. Dutch Law and Disputes

32.1 These Terms and the legal relationship between Psyki and the Participant are governed by Dutch law.

32.2 Any dispute arising from or relating to these Terms or Psyki’s services will be submitted to the competent court in the Netherlands, subject to any mandatory consumer jurisdiction rules that apply.

33. Participant Acknowledgements
